How to Handle an Injured on a Bicycle Claim

Bicycle accidents are often caused by drivers who are not paying attention to what’s around them or who are under the influence. When a bicyclist is injured while riding their bike, it’s imperative they know what to do and how to handle the claim. Tackling the claim and working to obtain the full amount of compensation the bicyclist is owed starts, when possible, immediately after the accident occurs. 

Gather Evidence At Scene

When someone is injured on a bicycle, they may require emergency medical care. If they are able to, before emergency services arrive, it’s a good idea for the bicyclist to take as many photos and videos of the accident scene as possible. Photos should include the scene of the accident, close-up photos of the bike and vehicle, damage to both the bike and the vehicle, and any injuries sustained by the bicyclist. These can be used to help prove damages if needed when filing a claim.

Bicycling accidents can lead to severe injuries, especially if the bicyclist is not wearing a helmet. Any time a bicyclist is injured in an accident, even if they can walk away from the accident and feel their injuries are minor, it’s important to seek medical care. Prompt medical care can not only help detect and treat hidden injuries but can also be used to show how severe the accident was and how much compensation is needed for the bicyclist. 

Look Into Repair Options for Bike

The bike will likely be damaged after an accident. In some cases, it may be necessary to purchase a new bicycle. In others, it may be possible to check the damage to the bike and then have it repaired. Save any receipts for repairs or replacements, as these should be reimbursed as part of the compensation received from the at-fault driver. It is suggested to avoid riding the bike until it has been repaired to prevent further accidents or injuries. 

File a Claim for Compensation

The bicyclist will need to file a claim with the at-fault driver’s insurance company. Typically, this is an easy procedure and will include filling out forms stating what happened and the injuries or damages sustained in the accident. It is important to be careful to avoid saying anything that could be seen as an admission of guilt, as that will make it more difficult to receive a full settlement. Additionally, this should be done as soon as possible to prevent missing deadlines.

Once the claim is filed, or before filing, the bicyclist may want to speak with a lawyer about the situation. A lawyer can help with filing the claim and reviewing any settlement offer received by the bicyclist. The help from a lawyer can ensure the bicyclist does not accept a settlement that’s far lower than what the case is worth, as that would mean paying out of pocket for any additional expenses.
